has provided copies of individual sheets sent to her for each project that has
offered to contribute FILM with regard to their specific project/development;
these date back to the early 1990's. She does not have a chart with all these
entered and totaled. You would have to add the figures from each sheet.
If you
want a certification as noted in your e-mail below, I am asking that Roger
Cleveland provide such certification. He can review the copies that Carol F.
has provided and that are in the Town Clerk's Office. I am asking that he come
to my office Monday, February 25, 2008 or Tuesday, February 26, 2008 to resolve
this matter.

The point is I want to know which ones are targeted
to be used for the New Hartford Business Park. Do the ones Carol provided
specifically total $478,000 and are they definitely the ones that are going to
be used for the New Hartford Business Park?
I would like certification that the ones provided
by Carol are the ones that have been specifically targeted to be used for the
New Hartford Business Park as stated in my FOIL request.

I have attached the slide that was presented at the
New Hartford Business Park Meeting. If there is a dollar amount made
public, someone must know how they arrived at that figure. It would be foolish
of me to make assumptions as to what fees they are using. There is nothing to
say they are even using land use fees.
Again, I would like to FOIL what project the Fees
are from, who the developer was that paid the fees, how much money each project
that required the fees in the first place is contributing to the $478,000 total
and what year the Fees In Lieu of Mitigation were collected from that
developer. I suspect that Roger Cleveland would be able to provide this
information since he is the one who spoke to the FILM monies during the meeting
at the high school.

I am looking for the specific FILM information as
outlined in my FOIL request of January 30, 2008; the FILM accounts that were
included in the dollar amount shown on the slide presented at the New Hartford
Business Park presentation. The total of the mitigation fees was listed as
$478,000. I am not looking for all Fees In Lieu of mitigation accounts. I am
assuming that if there is a dollar amount used for the slide presentation,
someone knows specifically what fees are going to be used for the New Hartford
Business Park project.
If that is not what Carol has, then this will not
satisfy my FOIL request. If the information is not what Carol is preparing, I
would like to know who has the information and how they arrived at the
$478,000. I can provide a copy of the slide if it will help.

At tonight's meeting regarding the New Hartford
Business Park, they said that $478,000 Fee in Lieu of Mitigation money would be
used to offset the cost of the bond.
I would like to FOIL what project the Fees are
